Montana's compliance landscape changed in October 2024 when the Montana Consumer Data Privacy Act took effect, with significant amendments under SB 297 effective October 2025. Unlike neighbouring Idaho, Montana now has a comprehensive consumer-privacy regime: rights to access, correct, delete, and copy personal data plus opt-outs of sale, targeted advertising, and profiling, enforced by the Attorney General with penalties up to $7,500 per violation. Notably, the law reaches businesses processing data on as few as 15,000 consumers when a quarter of revenue comes from data sales, a lower bar than most state laws. We design for that from day one.
