Washington has no comprehensive consumer-privacy law, but its My Health My Data Act (Chapter 19.373 RCW) is a first-of-its-kind health-data statute, enforceable since March 31, 2024 for regulated entities and June 30, 2024 for small businesses. It defines consumer health data very broadly (mental and physical health, reproductive and gender-affirming care, genetic and biometric data, and inferences), requires opt-in consent and a separate, prominently linked health-data privacy policy, and bans geofences of 2,000 feet or less around care facilities. It is enforced by the Washington Attorney General and, critically, carries a private right of action through the state Consumer Protection Act.
